New Jersey Department of Health proposes expansion of Deemed Status program for care homes

The New Jersey Department of Health has proposed amendments to the standards for licensure of assisted living residences, comprehensive personal care homes, and assisted living facilities. The proposal aims to expand the Deemed Status program to include Comprehensive Personal Care Homes.

Currently, deemed status allows an assisted living residence (ALR) to be recognized as compliant with licensure standards if it holds accreditation from a department-recognized organization. This accreditation serves in place of compliance being determined through inspection by department staff. The proposed changes would extend this recognition process to Comprehensive Personal Care Homes.

The notice regarding these proposed amendments was published in the January 5, 2026 issue of the New Jersey Register. Members of the public who wish to comment on the proposal can submit written comments electronically or by mail until March 6, 2026. Electronic submissions should be sent via www.nj.gov/health/legal/ecomments.shtml, while mailed comments should be addressed to Kimberly E. Jenkins, Director, Office of Legal and Regulatory Compliance at the New Jersey Department of Health.
